Adultery as a ground for divorce
Adultery is commonly known as sexual relationship between a married man or woman and someone who is not that person’s spouse. While defining this I have used the term relationship as we know Aristotle the legendary greek philosopher said, “Man is a social animal”. When we talk about social animals it refers to an animal which is highly interactive with other members of its species. It reflects the necessity of a relationship with other people who are present in our society. During ancient time people use to live together and their main objectives was to be only food and shelter but that time as well we have many examples of one man with three wife’s or one woman with 5 husband’s but this was not common between everyone because society have transformed there undeclared rule time to time for the betterment of the society so that there should be common standard practice for everyone who lives in the society. Therefore when we talk about adultery according to society their view for adultery is sin. Which will disturb the balance of society if it's commonly allowed or people accept its nature or start performing it as per their thoughts.
For restricting people to perform this sin society has developed a marriage ritual. which is accepted by different religions and also used as a standard process for the development of society but after marriage as well it has been heard of various incidents of adultery. Which impacted many lives of people & their family who had ignored society and was involved in the activity of adultery. If go through Adultery which is mentioned in the section 497 of Indian Penal Code, 1860 The law was made defunct on 27 September 2018 Which clearly states that “The law was made defunct on 27 September 2018 by Supreme Court of India as it called the law unconstitutional because it "treats a husband as the master.”
“Whoever has sexual intercourse with a person who is and whom he knows or has reason to believe to be the wife of another man, without the consent or connivance of that man, such sexual intercourse not amounting to the offence of rape, is guilty of the offence of adultery, and shall be punished with imprisonment of either description for a term which may extend to five years, or with fine, or with both. In such a case the wife shall not be punishable as an abettor.”
So any one may be man or woman whoever performs that activity which is not allowed by the law also which is popularly known as sin for the society creates ground for the other one whose life is getting spoiled by someone. who has legally or in the presence of the society has agreed to being together by the commitment of following certain specific rule which has been drawn by society & law as well which does not allowed adultery but due to any complications of relationship if any one gets involves in the adultery against person will be legally eligible for clamming Adultery as a ground for divorce for its betterment of situation which she/he is facing due to other one.
